Interpretation and Definitions

In these Terms of Service, "OutstaFlow", "we", "us", and "our" refers to OutstaFlow, operated from Queensland, Australia. "You" and "your" refers to the individual accessing or using our Service. "Service" refers to the OutstaFlow website (accessible at outstaflow.com) and the OutstaFlow macOS application. "License" refers to a paid license key purchased through LemonSqueezy granting access to premium features.

Acknowledgement

These Terms of Service govern your use of OutstaFlow and constitute the agreement between you and OutstaFlow. By downloading, installing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use the Service.

You represent that you are over the age of 18. We do not permit anyone under 18 to use the Service.

Your use of the Service is also conditioned on your acceptance of our Privacy Policy.

Bring Your Own Key (BYOK) Model

OutstaFlow operates on a bring-your-own-key model. You are required to provide your own API keys for third-party services (such as Groq) to use the Service's transcription and AI features. You are solely responsible for:

  • Obtaining and maintaining your own API keys from third-party providers.
  • All costs, charges, and fees incurred through your use of third-party APIs, including but not limited to transcription costs, AI processing costs, and any overage charges.
  • Reviewing and complying with the terms of service and pricing of any third-party API provider you use with OutstaFlow.
  • Keeping your API keys secure and confidential.

Third-Party API Pricing Disclaimer

OutstaFlow has no control over, and accepts no responsibility for, the pricing, availability, terms, or policies of third-party API providers including but not limited to Groq, Google Cloud, and any other service you may configure for use with OutstaFlow.

Third-party providers may change their pricing, rate limits, terms of service, or API availability at any time without notice to us. Any pricing estimates or cost examples provided on our website or in our documentation are for informational purposes only, are based on rates available at the time of writing, and may become outdated at any time.

You acknowledge and agree that OutstaFlow is not liable for any costs you incur through third-party API usage, including unexpected charges resulting from pricing changes, usage overages, or misconfigured API keys. It is your responsibility to monitor your API usage and costs directly with your third-party providers.

Licensing

License Types

OutstaFlow offers Annual ($10/year) and Lifetime ($99 one-time) license options. Licenses are purchased through LemonSqueezy and are subject to their terms of service.

Annual License

An Annual license grants access to all features and software updates for one year from the date of purchase. After one year, the app continues to function but will no longer receive updates unless the license is renewed.

Lifetime License

A Lifetime license grants access to all features and software updates for the lifetime of the product.

Free Tier

OutstaFlow may be used without a license with limited functionality: up to 10 minutes of dictation per day and up to 3 saved snippets. Free tier limits are subject to change at any time.

Refunds

Refund requests are handled through LemonSqueezy and are subject to their refund policy. Except where required by Australian Consumer Law, license fees are non-refundable. Refund requests may be considered on a case-by-case basis at our discretion.

Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble the Service.
  • Share, redistribute, or sublicense your license key.
  • Circumvent or attempt to circumvent license validation, usage limits, or other technical protections.
  • Use the Service to violate any applicable law or regulation.
  • Use the Service to infringe on the intellectual property or privacy rights of others.
  • Use the Service to generate content that is illegal, abusive, or harmful.

Intellectual Property

The Service, including its design, code, branding, and content, is owned by OutstaFlow and protected by copyright and intellectual property laws. You retain ownership of any content you create using the Service (e.g. transcribed text). We do not claim any rights over your content.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be error-free, uninterrupted, or secure.
  • Transcription results will be accurate, complete, or suitable for any particular purpose.
  • Third-party services (including Groq) will remain available, functional, or priced at any particular rate.
  • The Service will be compatible with future versions of macOS or third-party APIs.

Transcription accuracy may vary depending on audio quality, accent, background noise, language, and other factors. You are responsible for reviewing and verifying all transcription output before relying on it.

Limitation of Liability

To the maximum extent permitted by law, OutstaFlow and its operators shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, or business opportunities.
  • Costs incurred through third-party API usage, including unexpected charges, pricing changes, or service discontinuation.
  • Damages arising from inaccurate transcriptions or AI-generated content.
  • Damages arising from unauthorised access to your API keys or local data.

Our total liability for any claim related to the Service shall not exceed the amount you paid for your OutstaFlow license in the 12 months preceding the claim.

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded or limited by law.

Indemnification

You agree to indemnify and hold harmless OutstaFlow, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your use of third-party APIs in connection with the Service.

Termination

We may revoke your license or access to the Service if you breach these Terms. Upon termination, your right to use licensed features ceases immediately. The free tier may continue to function. You may stop using the Service at any time by uninstalling the application.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
